Terms of Use

1. Definitions

"Platform" means the JobPark ATS & CRM web application and all related services.

"Organization" means the company or HR agency that creates an account on the Platform.

"User" means an individual who accesses the Platform on behalf of an Organization (owner, admin, recruiter, etc.).

"Candidate" means a job seeker registered on the Platform by an Organization.

2. Account Registration

You must create an account with accurate and complete information to use the Platform. You are responsible for the security of your account, including your password, and for all activity that occurs under your account. Notify us immediately at info@jpark.io if you suspect unauthorized use.

3. Subscription Plans and Billing

The Platform offers Starter (free), Growth, Business, and Enterprise subscription plans. Each plan's monthly/annual price, active job posting limit, team member (seat) quota, and AI feature volume differ and are shown in the Organization panel.

Paid plans are billed in advance for the selected period (monthly or annual) and renew automatically at the end of the period unless cancelled beforehand. Amounts paid are non-refundable except where required by law.

Usage exceeding plan limits (e.g. extra seats or AI analysis packs) may incur additional charges.

4. User and Candidate Content

The Organization is fully responsible for all data it enters into the Platform (job postings, candidate CVs, notes, etc.) and must ensure this data is collected on a lawful basis, including candidate consent where required. JobPark only provides the technical infrastructure for storing and processing this data.

5. AI Features

The Platform offers AI-assisted features such as CV analysis, fit scoring, and job description generation. Results from these features are advisory in nature, and final hiring decisions must always rest with the Organization's own judgment. JobPark does not guarantee the accuracy of AI-generated results.

6. Prohibited Use

You may not use the Platform to: post unlawful content, infringe the rights of third parties, interfere with the Platform's operation (including automated scraping or excessive load), attempt unauthorized access to systems, or reverse-engineer the Service.

7. Intellectual Property

The Platform's design, code, logo, and brand belong to JobPark. Rights to content the Organization uploads to the Platform remain with the Organization; the Organization grants JobPark a limited license to process that content solely to provide the Service.

8. Suspension and Termination

Accounts that seriously violate these Terms may be suspended without prior notice. You may cancel your account at any time via Settings or by emailing info@jpark.io. After cancellation, data is retained for the period required by applicable law and then deleted.

9. Limitation of Liability

The Platform is provided "as is." JobPark is not liable for indirect, incidental, or consequential damages, including lost data or profits. JobPark's total liability is limited to the subscription fees you paid in the 12 months preceding the event giving rise to the claim.

10. Changes to These Terms

These Terms may be updated from time to time. You will be notified of material changes within the Platform or by email. Continued use of the Platform after changes take effect constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of Azerbaijan. Disputes will be resolved through negotiation where possible, and otherwise before the competent courts of the Republic of Azerbaijan.
